Terms of Service

By accessing or using passionwave.health, our mobile applications, or any related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not use the Platform.

These Terms constitute a legally binding agreement between you and Passionwave Technologies Pvt Ltd ("Passionwave", "we", "us", or "our"), with registered office at Mumbai, Maharashtra, India.

You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872, to use the Platform. By using the Platform, you represent and warrant that you meet these eligibility requirements and that the information you provide is accurate and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate, current, and complete registration information.
• Keep your password secure and not share it with others.
• Notify us immediately of any unauthorised use of your account.
• Complete identity verification (KYC) where required for certain services.

We may suspend or terminate your account if we reasonably believe these Terms have been violated.

Passionwave operates a marketplace that connects users with independent third-party professionals across healthcare, psychology, legal, lifestyle, and commerce verticals. Passionwave is a technology and facilitation platform only.

Passionwave is not a medical, healthcare, or legal services provider, does not practise medicine or law, and does not employ the professionals listed on the Platform. The professionals are independent practitioners solely responsible for the services they provide to you.

Any advice, consultation, diagnosis, treatment, opinion, or service provided by a professional through the Platform is the sole responsibility of that professional. Passionwave does not endorse, guarantee, or assume responsibility for any service, advice, or outcome provided by professionals.

Content on the Platform is for informational purposes only and is not a substitute for professional medical, legal, or other advice. In a medical emergency, contact your nearest hospital or emergency services immediately.

You agree not to use the Platform to:

• Violate any applicable law, regulation, or third-party right.
• Impersonate any person or misrepresent your identity or affiliation.
• Upload or transmit malicious code, spam, or harmful content.
• Attempt to gain unauthorised access to the Platform, accounts, or systems.
• Harass, abuse, or harm other users or professionals.
• Scrape, copy, or exploit Platform content or data without authorisation.

Fees for consultations, bookings, and products are displayed on the Platform before you confirm a transaction. All payments are processed securely through our payment partner, Razorpay. By making a payment, you agree to Razorpay's applicable terms in addition to these Terms.

You are responsible for paying all applicable fees and taxes. We reserve the right to change pricing at any time, but changes will not affect transactions already confirmed.

Cancellations, rescheduling, and refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms. Please refer to the Refund Policy for full details on eligibility, windows, and timelines.

All content, trademarks, logos, software, and materials on the Platform are owned by or licensed to Passionwave and are protected under applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works without our prior written consent. You retain ownership of content you submit, but grant us a limited licence to use it as necessary to operate the Platform.

To the maximum extent permitted by law, Passionwave shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from the acts, omissions, advice, or services of any professional. Our total aggregate liability for any claim arising out of or relating to the Platform shall not exceed the amount you paid to us in the three months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless Passionwave, its directors, employees, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Platform, your violation of these Terms, or your infringement of any third-party right.

These Terms are governed by and construed in accordance with the laws of India. Subject to the dispute resolution clause below, the courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.

Any dispute, controversy, or claim arising out of or relating to these Terms shall first be attempted to be resolved amicably. Failing amicable resolution, the dispute shall be referred to and finally resolved by arbitration conducted by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Mumbai, Maharashtra, and the proceedings shall be conducted in English.

We may amend these Terms from time to time. The revised Terms will be posted on this page with an updated "Last updated" date. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
